Description	مجلس الدولة هو مؤسسة شورية ذات شخصية إعتبارية يتمتع بالاستقلال المالي والإداري ومقره مدينة مسقط وهو يتكون من رئيس وأعضاء لا يتجاوز عددهم بالرئيس عدد أعضاء مجلس الشورى يعينون بمرسوم سلطاني ، وهو أحد عمودي مجلس عمان الذي يتكون من مجلسي الدولة والشورى. صدر المرسوم السلطاني السامي رقم (86/97) في شأن مجلس عمان ، والذي يتكون من مجلسي الدولة والشورى ، وقد جاء في ديباجه المرسوم أنه يأتي – أي مجلس عمان - توسعياً لقاعدة المشاركة في الرأي ، بما يؤدي إلى الاستفادة من خبرات أهل العلم وذوي الاختصاص ، ويسهم في تنفيذ استراتيجية التنمية الشاملة وخدمة الصالح العام. هذا وقد سبق إنشاء مجلس الدولة صدور النظام الأساسي للدولة بالمرسوم السلطاني السامي رقم (101/96) بتاريخ 6 من نوفمبر 1996م ، والذي بموجبه بدأت حقبة جديدة من مسيرة النهضة العمانية ، وقد نص هذا النظام في بابه الخامس على إنشاء مجلس عُمان الذي يتكون من مجلسي الدولة والشورى، وهي المؤسسات التي تسند إليها مهام الشورى في البلاد.
